Choosing a Divorce Lawyer or a Family Lawyer in large urban centers such as Toronto, Thornhill, Markham, Richmond Hill and Vaughan, can be very challenging due to the large amount of divorce lawyers and family lawyers practicing in these areas in Ontario.

Experienced divorce lawyers and family lawyers can help you through a very stressful time in your life and also help you avoid very costly financial and emotional mistakes. Very difficult and life altering decisions must be made, affecting many personal and important issues, such as child custody, child access or visitation, joint custody, child support, spousal support, property division, debt division, equalization of net family properties, the matrimonial home, separation agreements, among many others. Choosing the right divorce and family lawyer is the key to obtaining the best results in your divorce.

You and your children’s rights and well being may be affected for many years in the future. Divorce and family laws are full of many legal technicalities and are frequently subject to legal interpretation and your divorce lawyer or family lawyer must be experienced in these areas. Issues of child custody and child support can profoundly affect your children’s ongoing development.

If you or your spouse is considering divorce proceedings, it is essential that you consult a divorce and family lawyer to find out your rights and obligations. When you meet with a family and divorce lawyer, ask questions but, prepare your questions in advance – how is child custody, child access or visitation decided, what is joint custody or shared custody, how much will you receive or will you have to pay for child support and for how long, how does spousal support work, how will your property be divided and what is included, what happens to your home, who pays for your debts and loans, how much will it cost, what steps are involved in the process, how long will it take – can you settle or do you have to go to Court, what is a Separation Agreement -

Ask what the lawyer’s philosophy is about negotiating a settlement or litigating (going to court should be a last resort).

The family and divorce lawyer should be explaining all this and much more to you at your first meeting. Make sure the divorce and family lawyer you choose, answers your questions and makes you feel that you and your case is important and not just another number. Your lawyer should not talk to you in legalize but in plain ordinary language so that you understand exactly what is going on and what will happen in the future. You must choose a lawyer who you feel comfortable with and with whom you can trust to reveal your personal and confidential information and someone who will not make you feel foolish or uncomfortable for asking questions about things you do not understand.

Your divorce and family lawyer should be compassionate and understanding due to the emotional issues involved. Many divorce and family lawyers have gone through their own personal divorces and have experienced your situation personally as well as professionally and may be in a better position to empathize with you and understand exactly how you are feeling and how they can help you better.

Any person in the real estate business or people with such a background will know the powerfulness of a power of attorney. Everyone in this business need to do anything they can to survive, and get rid of any obstacle, which might come their way, which is why they believe in a power of attorney. Sometimes trusting the people close to you with your financial and business issues, might not be such a good idea. It is very easy for anyone to turn on you, therefore looking after your own business is the best thing you can do, or make sure you get someone from the legal world to handle it for you. It will eliminate any nasty surprises you might get in future. It is scary to think of what some people will do to get their hands on money.

If you realize how hard it is for you as a person to trust anybody close to you, imagine how hard it is for those people in the real estate business. There is absolutely nobody they can trust with their business dealings. If you do decide to implement a special power of attorney, then you need to look very carefully at whom you will trust with your money. It is not wise to give it to someone close to you, as mentioned before anyone can turn on you for money and greed. Having such a form in your business is beneficial to you, especially when you find it difficult to do as much as you did in the real estate world.

Please do not think that you are preparing for your possible death, when you consider a power of attorney. This really is not the case; all you are doing is looking after the things, which you worked so hard for every single day of your life. The last thing you need when you are not capable of working anymore is to loose everything in the hands of an irresponsible person. You can even give power of attorney to your agent to handle all of your policies, business transactions, medical issues, financial decisions and many more. You can even get the person acting on your behalf power to access your real estate forms and transactions so that you can get this off your hands as well.

It does not necessarily mean that you have to be incapable to work before you issue a power of attorney. If you and your spouse decide to go on a trip around the world for a month or two, you can issue a power of attorney to someone to look after everything while you are not here. By doing this, you will feel more relaxed about the business and enjoy your trip, more than you would have when you did not have an agent to look out for you. Whichever of the power of attorney forms you end up using, you need to make sure that it will suit your business needs.

If used properly and if conducted by a reputable Asset Search Company, asset searches can be used as a valuable pre-investment tool for an investor, partnership, joint venture or other business entity before entering into a contract. Often is the case when an investor or attorney has a client that is about to complete a deal and knows very little about the other side, other than what they know from “word of mouth” or Google. The question then becomes whether to take a chance and just invest and/or contract or whether one should do a little more digging to satisfy his or her “due diligence.“ Moreover, what duty does the investor or attorney have to the client to reveal potential liabilities, liens, lawsuits or state and federal criminal records that the subject has that could endanger the deal. Also, what happens to the attorney or investor who fails to inform the client, or other partners, that they could have conducted an asset search to uncover all existing liabilities?

Most asset searches cost less than $300.00. At www.assetsearchesplus.com, for example, a nationwide asset search costs $165.00 for an individual subject and $150.00 for a corporate entity. At the very least, shouldn’t the client or your partner be given the opportunity to pay for and conduct a search just in case there are significant liabilities associated with the subject or their company? If the client or partner refuses, the attorney and investor are protected. If the client agrees to conduct the search, then the investor and attorney and partner have satisfied their “due diligence” by conducting a nationwide asset search, which may very well reveal additional liabilities and exposure. In addition, where the subject may be concealing existing or prior litigation involving the subject matter of the deal or debt, prior bankruptcies, liens and the like, the asset search report will provide a road map for the investor, partnership or joint venture.

A thorough asset search provides existing assets of the subject, such as, what they own for real estate and other personal assets, together with the liabilities mentioned above that are associated with the subject, including but not limited to, other lawsuits, bankruptcies, state and federal tax liens, uniform commercial code filings and state and federal criminal records. These searches usually take 1-3 days to conduct. Detailed reports are then emailed to the investor to share with his or her client or partners. Upon receipt, an informed decision can be made with you and your counsel with how to proceed with the deal. Remember, “if there is nothing to obtain, there is nothing to gain.” If after reviewing the asset search report, it can be reasonably established that the subject(s) of the business deal is a legitimate player, then you can be more confident in entering into a contract or not… depending on the search results.

Under most circumstances, asset searches verify the following:

(a) The subject’s name and address and all alias names;

(b) Driver’s license information;

(c) Real estate;

(d) Motor vehicles;

(e) Watercrafts;

(f) FAA certifications and aircrafts;

(g) Professional licenses;

(h) Bankruptcies;

(i) Liens and court judgments;

(j) UCC filings;

(k) Corporate entities associated with the subject;

(l) Voter registration information;

(m) Sexual offenses;

(n) Employment information; and

(o) State and federal criminal records.

The only information that is usually needed from you or your client is the subject’s name and last known address, which can be filled out online or on an order form, which can be faxed and mailed to your office.

Finally, when choosing an asset search firm, make sure to ask the following questions:

1.)Does the firm have attorneys on staff that understands why you need the information and generate reports that are most useful for the joint venture, investor, attorney, partners or their clients?

2.)Do they only use “legal” and reliable sources and methods to conduct their searches?

3.)Does the firm stand behind the quality of their work?

4.)Does all work remain confidential?

5.)Does the firm provide a professional looking report that you will be eager to share with your client?
